THE COURT WILL NOT RECOGNIZE OUR REQUEST if we do not have at least a 2/3 vote (67%) of the homeowners supporting our objectives as required per our CCRs. We would prefer to have 100% - 65 homeowners.
Committed: 29 homeowners (45%)
Two Thirds Percent: 45 homeowners – SHORT 16 HOMEOWNERS
Eighty Percent: 52 homeowners – SHORT 23 HOMEOWNERS
NEED 36 HOMEOWNERS FOR 100%

Thank you to all that have stepped up to help keep our development in tact. I know times are tough, but I find it hard to beleive that our neighbors who have not committed yet to this process are fully aware of what is happening. I think we really need to get the word out...even a door to door if needs be (newsletter too) with all the info. and a date that the money needs to be in by. This is such a small price to pay for bigger dividends in the end! How quickly do we need to move?

I think I am confused on what that means by the court needs a 2/3 vote of the homeowners. How is the vote tallied? I would guess that the vote is yes for most people (homeowners), but will the courts only recognize a vote if the fee is paid?

Hey Mandy & Jen! I'm just a bit confused. I would love to be able to chat with anyone about our issues at hand, however, I've been unable to locate the name "Anonymous" on the homeowners listing.
I think we need to send out a message that lets everyone know we need their support. With the economy not doing so well, we're aware that some homeowners are unable to help support the cause financially. That is very understandable! We do however, need to know we have 100% of the communities support. We're all trying to protect out investments.
The laws governing our community – CCRs require:
2/3 vote for special action - each home owner gets only 1 vote
All annual and special assessments must be paid equally by all home owners
There are 23 items on the proxy that we are asking your permission to represent you and our community in legal action against Michael R. Mastro.
We are asking for each homeowner to contribute $150 to help defray the legal fees and associated expenses.
Joe Zehnder, Attorney At Law, and I, retired CPA, CIA (Certified Internal Auditor) and realtor, will not handle this issue under any other conditions.

Jim has written a special letter to homeowners that may not be aware of the issues at hand and have thus not committed to being on board with this by the contribution of the $150. The letters are being delivered today. We all feel the financial pinch at this time and I know some have expressed willingness to put more in the pot to help others, but then we start getting into more bookkeeping issues. I agree that commitment needs to come in the form of $150 and proxy assignment to the neighborhood Alliance. We may need to also keep in mind that whether we have control of this development or not we are still all liable if someone gets hurt here. If we take over the HOA we will at least have insurance to help cover the costs if this does happen and someone decides to sue. Just one more of many reasons to do what needs to be done now so we can have control.

I could not agree with you more. I believe there are quite a few neighbors who are somewhat unaware of what is going on. Many are not really aware of the blog or what is posted on there. Sure we have the updates left on our doors but there are many out there that have not attended the meetings and don't know just how crazy things are getting with the bankrupcy. I think going door to door is the best way to get the word out to those neighbors that may not otherwise know exactly what is going on. I am sure many of those folks would gladly pay the $150 if just asked.
